​Boys Town is committed to ensuring patients have access to information regarding their rights and responsibilities with the MyBoysTown patient portal and the privacy of their treatment information.​

    Accessing the website means you agree to these terms

    These Terms (“Terms") are a legal agreement between you (the end user of the Website) and Boys Town, (acting on behalf of its subsidiaries, affiliates, and licensors, collectively “Boys Town") and govern your access and use of the Website (defined below). Boys Town may amend these Terms from time to time. By your continued use of the Website, you agree to these Terms in their then current form. If you do not agree with the Terms, do not continue to use the Website.

    "Website," means all websites and pages located at this root domain: https://www.Boys Town.net/. Website excludes content that is located at other root domains.

    You may be required to accept or acknowledge additional terms when you navigate to certain pages of our Website, or to complete some transactions (See below Additional Terms).

    These Terms are organized as follows:

      You agree that the Terms and any dispute arising from or relating to the Terms shall be governed and construed in accordance with the laws of the State of Nebraska, excluding conflict of laws rules, and that any action based on or alleging a breach of these provisions must be brought in a state or federal court located in the State of Nebraska. In addition, you agree to submit to the personal jurisdiction and venue of such courts.

      5. Additional Terms.
      The Website is comprised of information, products and services provided by Boys Town as well as information, products and services provide in conjunction with, or solely by, third parties. In addition, the Website may contain links to other websites or access to applications. As a result, in order to access some information, products, services or websites you may be required to accept additional terms, or additional terms may be presented to or made available to you. The additional terms will supersede, modify, or supplement these Terms. To the extent that such information, product, service, or website is provided by a third party, Boys Town assumes no responsibility for such third-party information, products or services and you acknowledge that Boys Town is not responsible for the accuracy or other aspects such third party information, products, or services. Examples of such additional terms include but are not limited to terms appearing in association with the Epic patient portal (MyBoysTown).

      6. Copyright and Trademark Information
      All software, content, and the compilation of all content included on this Website is the property of Boys Town or its licensors and is protected by copyright laws. The Boys Town Health logo is a registered trademark of Boys Town. The product and service names profiled herein are proprietary marks of Boys Town. All other brands and names are the property of their respective owners.

      7. We will comply with the Digital Millennium Copyright Act 
      If you have any copyright concerns about materials posted on the Website, you agree to let Boys Town know. Pursuant to Title 17, United States Code, Section 512(C)(2), notifications of claimed copyright infringement should be sent to Boys Town's Designated Agent. An effective notification contains the following:

      • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
      • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online website are covered by a single notification, a representative list of such works at that website.

  • We respect your privacy. This Privacy Policy explains how we collect and use your personal information on this Website. Please read it carefully.
    This policy describes how Boys Town collects and uses personal information through this Website. Personal information does not include protected health information (PHI). The Notice of Privacy Practices describes how we use and disclose your PHI.

    What Information Do We Collect?
    Boys Town automatically collects certain information from your device when you visit the Website. This information includes information about:

    • Your device, such as which operating system or browser your device uses
    • The date and time you visited the Website
    • Where your device is located
    • Which pages on our website you have visited
    • Which page(s) on the Internet you came from

    What about Other Information and Websites?
    Boys Town uses third party service providers, including but not limited to Google Analytics, Adobe Analytics, and cookies to improve our service, user experience, and to analyze how the website is used. Aside from your device's Internet Protocol address (IP address), which can disclose your general location, the information collected by Google Analytics and Adobe Analytics is anonymized traffic data including length of stay on the Website, browser information, and device information. The collected information is used to provide an overview of how people are accessing and using the Website.     What About International Privacy Laws?
    Boys Town only offers services within the United States, and the Website is only intended to be used by users in the United States. If you are visiting the Website from outside the United States of America, your information will be transferred to, stored, and processed in the United States. By visiting the Website, you consent to the transfer of your information to the United States and the use and disclosure of your information as described in this Privacy Policy. Furthermore, you consent to the exclusive jurisdiction of the United States for purposes of any question of law or fact related to your use or access to the Website.

    With Whom Do We Share Personal Information?
    Our Service Providers. We may share your personal information with companies (including our affiliates) that perform services on our behalf, for example, companies that help process credit card payments. Our service providers are required by contract to protect the confidentiality of the personal information we share with them and to use it only to provide specific services on our behalf.

    Government and Legal Disclosures. We may disclose the personal information we collect through the Website, when we, in good faith, believe disclosure is appropriate to comply with law (or a court order or subpoena); to prevent or investigate a possible crime, such as fraud or identity theft; to enforce the Terms or other agreements with you; or to protect the rights, property or safety of Boys Town, our users, or others.

    What About Third-Party Sites or Applications?
    In accessing our Website, you may access portions which contain functions or content licensed by third parties.  How such third parties collect, use, and share personal information that they collect about you or that you provide to them is solely governed by such third party and any applicable license terms, terms of use or privacy policy. We are not responsible for the content or privacy practices of external internet sites or applications and recommend that you read the privacy policy of external sites and applications before disclosing any personal information.

    Security
    While we do our best to protect your personal information, we cannot guarantee the security of any information that you transmit to us and you are solely responsible for maintaining the secrecy of any passwords or other account information.

    COPPA Compliance
    The Website is not directed at children under the age of 13. We comply with the Children's Online Privacy Protection Act (“COPPA") and do not knowingly permit registration or submission of personally identifiable information by anyone under 13 years of age. If you believe information of a child under 13 has been submitted, please advise us in writing and we will delete it.

    California Do Not Track Notice
    Websites and web applications can track your movements on the Internet to better tailor suggestions for you based on your interests. However, some people do not want their browsing behavior to be tracked. As noted above, we do not track your movements on the Website over time or across third party websites to provide targeted advertising and therefore do not respond to Do Not Track (DNT) signals. However, some third-party sites do keep track of your browsing activities. This allows those websites to tailor what they present to you. While we do not charge fees to receive text messages, message and Data Rates from your wireless carrier may apply. Any costs incurred as a result are your responsibility. Messages may come from Boys Town directly and/or from third parties on our behalf.

    You may elect to receive electronic communications through a variety of methods including, but not limited to express statements in which you provide your email address or mobile telephone number in order that we can contact you to communicate information such as test results or appointment reminders, or through general consents where you provide your contact information for general correspondence related to our ongoing relationship with you as a healthcare provider. By providing your mobile number, you agree to receive voice and electronic communications by voice and text and by providing your e-mail address you agree to receive e-mail and agree that the that the device(s) and account(s) that will receive the electronic communications are appropriately secured.     Boys Town reserves the right to moderate comments on its social media platforms and may remove any content including advertising, profanity or offensive posts, as well as any off-topic commentary.​

  • What is MyBoysTown Proxy Access?

    MyBoysTown proxy access allows an authorized person to access data in another person's MyBoysTown healthcare record and/or mobile application. Health information accessible in MyBoysTown includes but is not limited to: past and future appointments, all messages to and from my healthcare provider(s), lab and radiology test results, immunizations and billing information.

    Often parents/legal guardians will use this mechanism to access their children's MyBoysTown accounts (typically, up until the child turns 19) so they can schedule appointments check immunizations, view test results, and coordinate other health-related information for their children, as permitted by state and federal law. Adults may use authorized proxy access to view a spouse, older parent or relative's information maintained in the MyBoysTown healthcare record. This can be particularly useful for helping monitor medications and appointments.

    In any proxy relationship, two people are involved. One of these is the patient whose chart is being accessed. The other is the person (i.e., the proxy) who receives authorization from the patient to access the patient's health information.

    How Do I Authorize and Terminate Proxy Access to MyBoysTown?

    Authorization is granted differently for child patients and adult patients.

    In a Parent/Legal Guardian-Child relationship, the parent/legal guardian coordinates access to the child patient's MyBoysTown account through the child's healthcare provider.  Once access is authorized, the parent/legal guardian can view the health information maintained in the child's MyBoysTown account.  When child reaches age 19, proxy access is automatically terminated, and the parent/legal guardian will no longer have access to the child's MyBoysTown record.

    In an Adult-Adult relationship, the adult patient coordinates access to his/her MyBoysTown account via the online MyBoysTown application portal.  MyBoysTown proxy access will only be granted to those persons authorized by the adult patient and who already have a registered MyBoysTown account.  Adult proxy access can be terminated by the patient upon submitting a written request to Boys Town and/or the patient's initiation of a change in his/her proxy access in the MyBoysTown portal.

    Proxy Access Terms and Conditions

    Please read carefully.  By authorizing proxy access using your MyBoysTown application portal, you agree that you've read, understand, and agree to the terms and conditions below:

    1. I understand that by granting proxy access to a third-party person, I am allowing that person's access to the complete contents of my MyBoysTown record. I understand that granting proxy access to a third party is completely voluntary.
    2. I understand that it is my responsibility to terminate my proxy's access to my MyBoysTown account if I no longer wish to allow him/her access to my MyBoysTown information. Termination of proxy access may not be immediate. Boys Town will use its best efforts to terminate your proxy's access within ten (10) business days of receiving a written request and/or receipt of the change in proxy access in the MyBoysTown portal.
    3. I understand that if my proxy shares his/her user ID and password with anyone, or if his/her user ID and password are lost or stolen, unauthorized parties may have access to my MyBoysTown health information. I understand that it is the responsibility of my proxy to keep his/her user ID and password secure and to change them anytime they believe their security has been compromised. I agree that it is also the responsibility of my proxy to log out of active MyBoysTown sessions and take appropriate precautions when accessing MyBoysTown from his/her home, business, or public computer and when printing or copying any MyBoysTown health information.
    4. I understand that my proxy's activities within MyBoysTown may be tracked by computer audit and that any entries and messages may become part of the medical record.
    5. I understand that access to MyBoysTown is provided a​s a convenience to me as a patient and that Boys Town has the right to deactivate my access or my proxy's access at any time for any reason or for no reason.
    6. I understand that my use of MyBoysTown is voluntary and that I am not required to use MyBoysTown.
    7. I hereby agree to waive any and all claims or causes of action against Boys Town, its affiliated entities, their officers, directors, employees, and agents that are in any way related to my proxy's use of MyBoysTown.
    8. I understand my authorization for a person's proxy access will remain in effect until revoked in writing or changed by me in the MyBoysTown portal.

    Our Responsibilities

    This notice describes how medical/treatment information about you may be used and disclosed and how you can get access to this information.­­ Please review it carefully.

    • ​​When it comes to your health/treatment information, you have certain rights. This section explains your rights and some of our responsibilities to help you.​
      ​Get an electronic or paper copy of your medical/ service recipient record
      • ​​You can ask to see or get an electronic or paper copy of your medical/service recipient record and other health/treatment information we have about you. Ask us how to do this.
      • We will provide a copy or a summary of your health/treatment information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.​

      • You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address.
      • We will say “yes" to all reasonable requests.
      Ask us to limit what we use or share
      • You can ask us not to use or share certain health/treatment information for treatment, payment, or our operations.
        • We are not required to agree to your request, and we may say “no" if it would affect your care.
      • If you pay for a service or health care item out-of-pocket in full, you can ask us not to share that information for the purpose of payment or our operations with your health insurer.
        • ​​We will say “yes" unless a law requires us to share that information.​
      ​Get a list of those with whom we've shared information
      • You can ask for a list (accounting) of the times we've shared your health information for six years prior to the date you ask, who we shared it with, and why.
      • We will include all the disclosures except for those about treatment, payment, and health care operations, and certain other disclosures (such as any you asked us to make). We'll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.
      Get a copy of this privacy notice
      • You can ask for a paper copy of this notice at any time, even if you have agreed to receive the notice electronically. We will provide you with a paper copy promptly.
      Choose someone to act for you
      • If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information.
      • We will make sure the person has this authority and can act for you before we take any action.
      File a complaint if you feel your rights are violated

      • We will not retaliate against you for filing a complaint.​​​
    • ​For certain health/treatment information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations described below, talk to us. Tell us what you want us to do, and we will follow your instructions.
      In these cases, you have both the right and choice to tell us to:
      • Share information with your family, close friends, or others involved in your care
      • Share information in a​ disaster relief situation
      • Include your information in a hospital directory
      • Contact you for fundraising efforts

      If you are not able to tell us your preference, for example if you are unconscious, we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety.

      In these cases, we never share your information unless you give us written permission:

      • Sale of your information
      • Most sharing of psychotherapy notes
      In the case of fundraising:

    • How do we typically use or share your health information​? We typically use or share your health information in the following ways.
      Treat youWe can use your health/treatment information and share it with other professionals who are treating you. Example: A doctor treating you for an injury asks another doctor about your overall health condition.
      Run our organizationWe can use and share your health/treatment information to run our practice, improve your care, and contact you when necessary. Example: We use health information about you to manage your treatment and services.
      Bill for your servicesWe can use and share your health/treatment information to bill and get payment from health plans or other entities. Example: We give information about you to your health insurance plan so it will pay for your services.​

      How else ca​n we use or share your health information? We are allowed or required to ​share your information in other ways – usually in ways that contribute to the public good, such as public health and research.       Help with public health and safety issues​

      We can share health/treatment information about you for certain situations such as:

      • Preventing disease​
      • Helping with product recalls
      • Reporting adverse reactions to medications
      • Reporting suspected abuse, neglect, or domestic violence
      • Preventing or reducing a serious threat to anyone's health or safety
      Do researchWe can use or share your information for health research.

    Changes to the Terms of This Notice

    We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our office, and on our web site.

    This Notice also describes the privacy practices of an organized health care arrangement or "OHCA" between Boys Town National Research Hospital (BTNRH) and its Medical Staff in which BTNRH and its Medical Staff share medical information from inpatient and outpatient hospital visits for treatment, payment and health care operations. All Members of the BTNRH Medical Staff will follow this Notice when providing services at BTNRH facilities including outpatient clinics.  This Notice does not cover the information practices of practitioners in their private offices or at other locations when such practitioners are not employed by BTNRH.

    • Cuando se trata de su información médica/tratamiento, usted tiene ciertos derechos. Esta sección explica sus derechos y algunas de nuestras responsabilidades para ayudarlo.

      Obtener una copia en formato electrónico o en papel de su historial medico/destinario de servicios

      • Puede solicitar que le muestren o le entreguen una copia en formato electrónico o en papel de su historial medico/destinario de servicios y otra información médica que tengamos de usted. Pregúntenos cómo hacerlo.
      • Le entregaremos una copia o un resumen de su información médica/tratamiento, generalmente dentro de 30 días de su solicitud. Podemos cobrar un cargo razonable en base al costo.
      Solicitarnos que corrijamos su historial medico/destinario de servicios
      • Puede solicitarnos que corrijamos la información médica/tratamiento sobre usted que piensa que es incorrecta o está incompleta. Pregúntenos cómo hacerlo.
      • Podemos decir “no" a su solicitud, pero le daremos una razón por escrito dentro de 60 días.

      Solicitar comunicaciones confidenciales

      • Puede solicitarnos que nos comuniquemos con usted de una manera específica (por ejemplo, por teléfono particular o laboral) o que enviemos la correspondencia a una dirección diferente.

      Solicitarnos que limitemos lo que utilizamos o compartimos

       

      • Puede solicitarnos que no utilicemos ni compartamos determinada información médica/tratamiento para el tratamiento, pago o para nuestras operaciones. No estamos obligados a aceptar su solicitud, y podemos decir “no" si esto afectara su atención.
      • Si paga por un servicio o artículo de atención médica por cuenta propia en su totalidad, puede solicitarnos que no compartamos esa información con el propósito de pago o nuestras operaciones con su aseguradora médica. Diremos “sí" a menos que una ley requiera que compartamos dicha información.

      Recibir una lista de aquellos con quienes hemos compartido información

       

      • Puede solicitar una lista (informe) de las veces que hemos compartido su información médica durante los seis años previos a la fecha de su solicitud, con quién la hemos compartido y por qué.
      • Incluiremos todas las divulgaciones excepto aquellas sobre el tratamiento, pago y operaciones de atención médica, y otras divulgaciones determinadas (como cualquiera de las que usted nos haya solicitado hacer). Le proporcionaremos un informe gratis por año pero cobraremos un cargo razonable en base al costo si usted solicita otro dentro de los 12 meses.
      Obtener una copia de esta notificación de privacidad
      • Puede solicitar una copia en papel de esta notificación en cualquier momento, incluso si acordó recibir la notificación de forma electrónica. Le proporcionaremos una copia en papel de inmediato.

      En estos casos, tiene tanto el derecho como la opción de pedirnos que:
      • Compartamos información con su familia, amigos cercanos u otras personas involucradas en su atención.
      • Compartamos información en una situación de alivio en caso de una catástrofe.
      • Incluyamos su información en un directorio hospitalario.

      Si no puede decirnos su preferencia, por ejemplo, si se encuentra inconsciente, podemos seguir adelante y compartir su información si creemos que es para beneficio propio. También podemos compartir su información cuando sea necesario para reducir una amenaza grave e inminente a la salud o seguridad.

      En estos casos, nunca compartiremos su
      información a menos que nos entregue un permiso por escrito:
      • Propósitos de mercadeo.
      • Venta de su información.
      • La mayoría de los casos en que se comparten notas de psicoterapia.

      En el caso de recaudación de fondos:

       

      • Podemos comunicarnos con usted por temas de recaudación, pero puede pedirnos que no lo volvamos a contactar.

      Tratamiento

      Podemos utilizar su información médica/tratamiento y compartirla con otros profesionales que lo estén tratando.

      Ejemplo: Un médico que lo está tratando por una lesión le consulta a otro doctor sobre su estado de salud general.

      Dirigir nuestra organización

       

      Podemos utilizar y divulgar su información para llevar a cabo nuestra práctica, mejorar su atención y comunicarnos con usted cuando sea necesario.

      Ejemplo: Utilizamos información médica sobre usted para administrar su tratamiento y servicios.
      Cargos por sus servicios

      Podemos utilizar y compartir su información para facturar y obtener el pago de los planes de salud y otras entidades.

      Ejemplo: Entregamos información acerca de usted a su plan de seguro médico para que éste pague por sus servicios.

      De qué otra manera podemos utilizar o compartir su información médica? e nos permite o exige compartir su información de otras maneras (por lo general, de maneras que contribuyan al bien público, como a salud pública e investigaciones médicas). Tenemos que reunir muchas condiciones legales antes de poder compartir su información con dichos propósitos.       Ayudar con asuntos de salud pública y seguridad

       

      Podemos compartir su información médica/tratamiento en determinadas situaciones, como:

      • Prevención de enfermedades.
      • Ayuda con el retiro de productos del mercado.
      • Informe de reacciones adversas a los medicamentos.
      • Informe de sospecha de abuso, negligencia o violencia doméstica.
      • Prevención o reducción de amenaza grave hacia la salud o seguridad
        de alguien.
      Realizar investigaciones médicas

      Podemos utilizar o compartir su información para investigación de salud.

      Cumplir con la ley

      Podemos compartir su información si las leyes federales o estatales lo requieren, incluyendo compartir la información con el Departamento de Salud y Servicios Humanos si éste quiere comprobar que cumplimos con la Ley de Privacidad Federal.

      Responder a las solicitudes de donación de órganos y tejidos

      Podemos compartir su información médica con las organizaciones de procuración de órganos.

      Trabajar con un médico forense o director funerario

      Podemos compartir información médica con un oficial de investigación forense, médico forense o director funerario cuando un individuo fallece.

      Tratar la compensación
      de trabajadores,
      el cumplimiento de la ley y otras solicitudes gubernamentales

      Podemos utilizar o compartir su información médica/tratamiento:

      • En reclamos de compensación de trabajadores.
      • A los fines de cumplir con la ley o con un personal de las fuerzas de seguridad.
      • Con agencias de supervisión sanitaria para las actividades autorizadas por ley.
      • En el caso de funciones gubernamentales especiales, como los servicios de protección presidencial, seguridad nacional y servicios militares

      Responder a demandas y acciones legales

      Podemos compartir su información médica/tratamiento en respuesta a una orden administrativa o de un tribunal o en respuesta a una citación.

      • Estamos obligados por ley a mantener la privacidad y seguridad de su información médica protegida.
      • Le haremos saber de inmediato si ocurre un incumplimiento que pueda haber comprometido la privacidad ao seguridad de su información.
      • Debemos seguir los deberes y prácticas de privacidad descritas en esta notificación y entregarle una copia de la misma.
      • No utilizaremos ni compartiremos su información de otra manera distinta a la aquí descrita, a menos que usted nos diga por escrito que podemos hacerlo. Si nos dice que podemos, puede cambiar de parecer en cualquier momento. Háganos saber por escrito si usted cambia de parecer.

Todos los miembros del personal médico del BTNRH seguirán este aviso cuando proporcionen servicios en las instalaciones del BTNRH, incluyendo clínicas de pacientes externos. Este aviso no cubre las prácticas de información de los Doctores en sus oficinas privadas o en otras ubicaciones cuando tales Doctores, no son empleados por el BTNRH.
